Does Ohio Lemon Law Cover Used Cars?
You bought a used car and something’s already wrong. Before you do anything else, you want to know, does Ohio Lemon Law even cover me?
It’s one of the most common questions we get and unfortunately, the answer is not as straightforward as we’d like, but here is a breakdown of what you should know:
Ohio’s Lemon Law applies to new cars with defects that arise within the first 12 months or 18,000 miles of the vehicle’s original delivery date (not the date you bought it used). That’s a very important piece of information to consider.
So, let’s say the car sold in April of 2025 and you bought it used in March of 2026, you are just shy of a year in and Lemon Law coverage is about to go away. If it’s over 18,000 miles, you are already out of luck with filing any kind of lemon claim.
When would my used car still qualify as a lemon?
If you have reported it within the first year or 18,000 miles from the original in service date, then you would have a stronger claim if the same issue on your car has been repaired more than three times without it actually solving the problem and/or if a single repair attempt was made on a defect likely to cause death or serious injury and it still wasn’t resolved.
If you’ve had your car in the shop for over 30 days under warranty, this is also a huge part of filing a lemon claim.
What happens if I miss the Lemon Law window to file a claim?

The Magnuson-Moss Warranty Act
This is a federal law dating back to 1975 and it could help you in court even if you are outside the Lemon Law period. Like Ohio’s Lemon Law, it includes a fee-shifting provision, meaning the manufacturer may have to cover your attorney’s fees if you win.
The Ohio Consumer Sales Practices Act (CSPA)
This is a state law and it covers both new and used car transactions and prohibits dealers and manufacturers from misrepresenting a car’s capabilities, hiding known defects or breaching the warranty. The CSPA may entitle you to cancel the sale or recover up to three times your actual damages, plus attorney’s fees.
Ohio’s Lemon Law has limitations when it comes to used cars, but that doesn’t mean you’re without a case.
