what is the NEW YORK
lemon law?

In New York, the Lemon Law specifically covers vehicles that have issues in the first two years or 18,000 miles from the original in service date. New York’s laws are only applicable to vehicles that are sold in New York and registered in New York.

A manufacturer must repair the defect within a “reasonable” number of repair attempts. There is a presumption that the number of attempts was unreasonable if it was subjected to four or more repairs for the same problem and continues to exist or that it was out of service for at least 30 days.

DOES THIS MEAN USED CARS ARE PRECLUDED?

No! If the vehicle was purchased within the statutory period and had problems, it may still qualify for Lemon Law protection. Or, if the vehicle was purchased with a balance of a manufacturer’s warranty but was outside the Lemon Law period, you may still have a claim under the Magnuson-Moss Warranty Act or even a little known law unique to New York for used cars, for damages if it was subjected to repeated problems!
